The new stylish compact digital camera DMC-FX90 adds a Wi-Fi® connectivity (802.11 b/g/n) to the superior camera performance in a slim, stylish profile. Considering the fact that many people take photos or videos not only for their record but also for sharing them with friends or families, the DMC-FX90 offers users a great ease and convenience for enjoying it more. Users can upload the photos and videos they shot right on the spot via the mobile network using a smart phone. They can get the Internet access anywhere without a need of searching a Wi-Fi® hotspot. The wireless connection also makes it possible to copy the images to PC or to send the images via a designated access point at home.
The DMC-FX90 is not just a communication camera but it features outstanding performance packed in a slim, stylish body. The LEICA DC VARIO-SUMMARIT lens 24mm ultra wide angle 5x optical zoom (equivalent to 24mm to 120mm on a 35mm camera) with F2.5 brightness excels not only in shooting dynamic landscapes with its wide angle of view but also in capturing moving subjects even in low-lit situations such as indoors or at night with its outstanding brightness. The 12.1-megapixel Hi-Speed CCD sensor, the DMC-FX90 is compatible with high-speed, large-capacity signal processing required for 1920 x 1080 60i (NTSC, sensor output 30p) full-HD video recording in AVCHD. Alternately, videos can be recorded in MP4 format to play it back directly on the PC or other portable electronic devices without a need of conversion.

With a Smart Touch operation, all control is possible by the touch operation - Touch AF, Touch Zoom or Touch Shutter during recording and various playback functions including Beauty Retouch and Art Retouch mode.
The iA (Intelligent Auto) mode lets users leave everything to the camera to take beautiful photo and video. The Active Mode in the MEGA O.I.S suppresses blur when recording video at wide angle in shooting while walking. Wi-Fi® Connectivity for Easy, Instant Communication by Image Sharing
Considering the increasing number of global online image sharing activity, the DMC-FX90 integrates a Wi-Fi® connectivity (802.11 b/g/n) to encourage users to enjoy it with more ease. With its Wi-Fi capability, user can post the images shot with the camera on the target social image sharing service such as Facebook™, Flickr™, Picasa™ or YouTube™. Panasonic is also launching a new service "LUMIX CLUB" for the users of DMC-FX90 (detailed information is available separately) to offer external site link function to support easy SNS posting using DMC-FX90 without having to worry about complicated settings. Once acquired an account of LUMIX CLUB on the camera, users can compile the log-in information for the social services in it. This means that they do not have to log in each service separately but they can directly start the activity on the service at once. It is even possible to share images on different social services at a time.
Initial setting and uploading of the photos or videos are extremely easy. For smartphones, Panasonic provides a free, dedicated application program "LUMIX LINK" for both iPhone® and AndroidOS smartphones and all control is available with this program. Activating the application "LUMIX LINK" and log in "LUMIX CLUB" on the smartphone or on the PC browser, users can upload the photos and videos you want in the camera anywhere via a mobile network without a need of finding a special access point. At home, users can directly upload the images to the image sharing service via the access point of home router. It is also possible to transfer the images to their PC with the wireless connection.
For instant access, a dedicated Wi-Fi button is provided. Just pressing it directly opens a Wi-Fi Connection mode outside home and gets WPS (Wi-Fi Protected Setup) connection at home. The Wi-Fi module is incorporated on the opposite side of grip not to interfere the connection signal.
Bright, High Quality F2.5 LEICA DC VARIO-SUMMARIT Lens with 24mm Ultra Wide-Angle and 5x Optical Zoom
The DMC-FX90 incorporates a newly developed high quality LEICA DC VARIO-SUMMARIT lens that boasts excellent brightness of F2.5. The F2.5 lens is even brighter by approx. 25% than the F2.8 lens which is generally considered a bright lens. It allows the use of higher shutter speed but captures stunningly clear, sharp, blur-free images even in lower lighting situation. Together with the anti-blurring function in the iA mode, DMC-FX90 powerfully suppress blur caused by the movement of subjects. Also, the 24mm (35mm camera equivalent: 24-120mm ) ultra-wide-angle lens - rare on a compact camera - gives photographers a wider range of composition possibilities with approx. 213% larger viewing space compared to that of 35mm camera. The super-high-quality LEICA DC VARIO-SUMMARIT lens minimizes distortion at the wide end.
Comprising of 7 elements in 6 groups with 3 aspherical lenses with 5 aspherical surfaces, the lens unit in DMC-FX90 realized downsizing of both total length and diameter to fit in the slim, compact body of the camera. It is made possible with its mechanism and the use of Extra High Index Low Dispersion Meniscus Aspherical Lens as thin as 0.3mm. Panasonic succeeded in developing the lens with high refractive index and low dispersion performance which results in the excellent color reproduction and suppression of chromatic aberration.
This advanced lens unit passes Leica's stringent standards and delivers an exceptional optical performance with its minimal distortion and chromatic aberrations while suppressing ghosting and flaring.
Thanks to the Intelligent Resolution technology, the Intelligent Zoom is available with the DMC-FX90 which extends the zoom ratio by approx. 1.3x maintaining the picture quality even using a digital zoom. This means the 5x optical can virtually extend to 6.5x equivalent.
Advanced Signal Processing System with 12.1-megapixel Hi-Speed CCD and High Performance Venus EngineFor the image processor, the Venus Engine is incorporated that features exceptionally advanced signal processing capabilities. By separating chromatic noise from luminance noise and applying the optimal noise reduction to each, you can capture clear and beautiful images even when shooting at high ISO sensitivity levels. The Venus Engine also provides precisely selective noise reduction to the chromatic noise without affecting the border of colors which is judged from the brightness level of a pixel. Plus, the Intelligent Resolution technology precisely performs signal processing pixel by pixel in the most effective way for it which is apart from the uniform enhancement of sharpness. As a result, images are naturally clear and crisp in both photo and video recording.
Linking smoothly with the Hi-speed CCD sensor, the Venus Engine processes a large amount of signals at high speed, making it possible to record 1,920 x 1,080 full-HD video recording and high resolution consecutive shots at 3.7 fps in 12.1-megapixel full resolution and max.10 fps at 3-megapixel recording.
At the same time, the multi-task image processing realizes quick response making it easier to capture sudden, spur-of-the-moment photo opportunities.

The 12.1-megapixel CCD with 2-channel signal output structure boasts higher signal transfer speed for the operations that require high performance and speed such as 1920 x1080 full HD video recording and high speed continuous shooting. The picture quality is also improved thanks to the approx. 25% higher sensitivity* which is made possible by highly efficient light condensation adoption larger on-chip micro lenses.
According to the rise of video recording popularity, digital cameras are now more compatible with it. The DMC-FX90 has recording capability of AVCHD video even in 1,920 x 1,080 60i (NTSC, sensor output 30p) full-HD despite its slim, stylish body. Alternately, user can choose MP4 for video recording, which has higher compatibility with PCs. The DMC-FX90 also boasts Dolby Digital Creator to record high quality audio.
Now on the DMC-FX90, the popular iA (Intelligent Auto) mode is also available in motion image recording. The AF Tracking function that can lock onto the subject by just touching it on the screen to keep it in focus even it moves is now available in video recording, too. The MEGA O.I.S. (Optical Image Stabilizer), Face Detection, Intelligent Scene Selector and Intelligent Exposure also support shooting beautiful video with ease. The 5x optical zoom is available in video recording, too. With the Video Divide function, users can divide the video into two sections to shorten or delete the unwanted part on the spot in the camera. You can cut out a clear still image from a video in the camera thanks to the Intelligent Resolution technology. A Wind Cut function is also available to block out most of the noise from background wind.

The 3.0-inch Smart Touch Screen for Intuitive Touch-Control Shooting and Additional Fun
The DMC-FX90 adopts full touch-screen operation with 460,000-dot Smart Touch Screen. Auto Focus is immediately set to the subject by just touching it on the large LCD and you can even release the shutter.
Once you lock on the subject by a touch, the camera tracks the subject with the AF tracking function even if it moves. With the Intelligent Scene Selector in the iA mode, the camera automatically switches to the appropriate mode according to the subject touched. For example, a touch on a human face switches to the portrait mode and a touch on the background or scenery to the scenery mode while a touch on the subject close to the camera to the close-up mode. All menu setting is now available with touch control. In the shooting screen you can directly touch the icon to change its setting quickly.
The functions and settings used most often, such as O.I.S., consecutive shooting, auto focus point, white balance setting, ISO sensitivity level, image size and LCD mode are quickly and easily accessed via the shortcut setting by just dragging the icon to the main menu area.
Taking advantage of the touch operation, various functions are incorporated to add more fun to DMC-FX90. The Beauty Retouch mode makes it possible to virtually make up the faces. In Aesthetic Retouch, various effect can be applied to the face including clearing the skin texture, lifting up the face whitening of teeth and so on. In the Make-up Retouch, users can choose the color of foundation, lips, cheeks or eye-shadow. The Art Retouch function lets users give different impression to the photo in camera from the original. Brightness can be changed with exposure and the color with saturation. It is possible to retouch and make the photo, even if it is washed-out or colorless, look in the way you wish to be by combining two parameter settings - more natural, softer, or more vivid to suit your preference of color manner.
The touch-screen operation excels not only for shooting but also for playing back images with outstanding visibility. You can play back the image you want out of hundreds of stocks by touching in the thumbnails. My Photo Album function lets users to sort images in the separate folders allowing quick, direct playback of the images they want without searching a huge collection of photos. For example, you can sort photos regarding work or those shot in private. This is also convenient when transferring the images because you can just copy the target folder in a SD card to the PC without selecting the photos you need one by one.
The Intelligent LCD automatically adjusts the screen brightness in 11 steps as the surrounding brightness level changes, ensuring easy visibility at all times.
The Evolving iA (Intelligent Auto) Mode Makes Every Photo and Video More Beautiful
Panasonic incorporated the Intelligent Auto mode in pursuit of the ultimate ease of operation and the reduction of misshots. In the iA mode, the camera does all the work, leaving you free to compose shots and capture moments. Just press, aim and shoot.
For more effective countermeasure against blur, the Active Mode is equipped with DMC-FX90 for an option of image stabilization in video recording. This mode is especially effective in active video recording at wide angle such as shooting while walking.
With the DMC-FX90, the Motion Deblur mode* is incorporated to prevent blur due to the subjects movement even more powerfully by setting appropriate ISO setting and shutter speed automatically according to the subjects motion. Combined with the outstanding brightness of the lens and the Active Mode, the DMC-FX90 thoroughly prevents any kind of blur - whether out of handshake or the subject's motion, whether in photo or video recording.
Not only those, the Face Recognition function remembers registered faces to give an appropriate AF/AE on the people while removing the unwanted red-eye. The Intelligent Scene Selector automatically selects whichever of 6 Scene modes - Macro, Portrait, Scenery, Night Portrait, Night Scenery and Sunset - that best suit the shooting situation.
In addition, the Intelligent Resolution technology is always activated in the iA mode which results in the clearer and higher picture quality in every photo and video with extended zoom range equivalent to 6.5x optical zoom by the Intelligent Zoom.
Plus, the light control of flash is optimized according to the scene more precisely and the portrait shots using flash, which tends to be overexposed, are now even more beautiful.
Once you enter the iA mode, these functions happen automatically together with other powerful shooting-assist functions - AF Tracking, Intelligent ISO Control and Intelligent Exposure - so you can shoot without the bother of adjusting settings every time conditions change. Other Exciting Features for More Fun of Photography
The 3D Photo mode produces a realistic, less-distorted 3D image in the camera. Take 20 panning shots and the camera automatically selects two most suitable images - one for the right eye and one for the left eye - to synthesize a 3D composite. The 3D image can be viewed on VIERA 3D HDTV. The format of 3D image is compatible with MPO which can be played back on other MPO-compatible equipment such as TV, Digital Photo Frame or Printing.
The DMC-FX90 also features a convenient way of sharing photos or videos - LUMIX Image Uploader. All you have to do is checkmark the photos you want to share in the camera and connect the camera to a PC. You can choose to send it immediately on the spot or later. Uploading automatically starts just by following the guidance. Facebook™ can be used for photos and YouTube for movies. Users can join these social networking services without installation of special software. It is easy to share photos and videos on the spot, which means that your friends do not have to wait for you to come back home. Users can also utilize conventional LUMIX Image Uploader to send images for Wi-Fi connection.
A total of 28 scene modes such as popular Baby or Pet, sets most appropriate parameter in wide-ranging situations.
Photos or videos recorded in AVCHD on SD Memory Cards are easy to view on a Panasonic VIERA TV. Simply insert the card into the VIERA Image Viewer (SD Memory Card slot) on VIERA TV or Blu-ray Disc Recorder/Player to playback your contents. Alternatively, you can use an optional micro HDMI cable to output the still and motion images you took from the FX90 directly to the TV for VIERA Link.
About PHOTOfunSTUDIO 6.4 HD Lite Edition with Wi-Fi
The PHOTOfunSTUDIO 6.4 HD Lite Edition with Wi-Fi makes it possible to sort and organize photos not only of those newly taken but also of those stored in your PC with quick start-up and fast read-in of images. Once installed in the PC, the DMC-FX90 can transfer the selected images to backup them in the PC via the wireless network. For the portraits, the Face Recognition function that recognizes the faces in the picture automatically sorts the photos by the registered faces without picking out each photo one by one when you only want pictures of a specific person.
Recorded videos can be edited with the Short Movie Story function and written into MPEG2 to burn onto a DVD disc. You can also enjoy making photo and video slideshows with a variety of effects and use your iTunes® music library as background music. It is also possible to put a title or add comments on the scene utilizing the information from the people's names registered in Face Recognition. In addition to the direct connection of the camera, you can upload photos to Facebook™ and videos to YouTube™ or Facebook ™ via this software, too.

Your Plan is priced to offer you affordable protection for your valuble electronics product. The coverage will cost you just pennies a day and there are no deductibles.
This document sets forth the entire Contract between the Service Contract Administrator hereinafter referred to as We, Us and Our, and, the Purchaser as You and Your. No representation, promise or condition herein shall modify these terms. Service Net Warranty, LLC ("Service Net") is contractually obligated to You to provide service under this Contract where in accordance with, and as allowed by state law. If this Contract is purchased in Florida or Oklahoma, Service Net Solutions of Florida, LLCis contractually obligated to You to provide service under this contract.
1.What Is Covered. We will furnish labor, parts, and/or replacement equipment (or pay for same) necessary to repair operational or mechanical breakdowns of the product specified in this Contract, provided such service is necessitated by product failure during normal usage. The product specified and covered includes only equipment as originally configured and charged for in this Contract. Coverage also applies to the parts and accessories that are necessary to the covered product's functionality, but does not apply to accessories that are used in conjunction with or to enhance the performance of the covered product. The maximum liability owed to You under this Contract will be the full retail cost of Your Product minus the sales tax. In the event We (I) replace the Product with a Product with equivalent specifications or (II) reimburse You for the current market value of the Product with equivalent specifications or (III) reimburse You for the retail amount of the Product, less claims made, minus sales tax, We shall have satisfied all obligations owed under this contract. Power Surge and Spike: This service plan protects against operational failure of a covered product if a failure occurs while connected to a surge protector approved by the Underwriter's Laboratory. Your surge protector may be collected by the Administrator for examination.
2.TO OBTAIN AUTHORIZATION FOR REPLACEMENT (ON REPLACEMENT CONTRACTS ONLY):
You must obtain authorization prior to the receipt of a replacement Product.

Have this Contract, Your Contract number, and the original Product receipt available.
Instructions on obtaining replacement will be given.
Once authorization is obtained You may be required, at Your expense, to return the Product to Service Net.
This Product is not to be taken to the Retailer.
At Our determination, You will receive a replacement Product of like grade and quality. Technological advances may result in a replacement product with a lower selling price than
the original Product. In all cases where a replacement cannot be made, You will receive reimbursement for the original purchase price, excluding sales tax, delivery and installation.
All contractual obligations are considered fulfilled upon Product replacement, reimbursement or Contract term expiration.
We reserve the right to replace the Product with a remanufactured or refurbished Product.
The replacement Product will be mailed to You at no cost.
3.DEDUCTIBLE. No deductible applies to this Contract.
4.IMPORTANT NOTE. Repairs recommended by the repairing facility not necessitated by mechanical breakdown are not covered unless specifically authorized by Us. We reserve the right to inspect the items to be covered, or the items covered, as the case may be, prior to coverage or during the coverage period. Model number, serial number and original date of purchase of all items to be covered must be provided to execute application for service. If You request a service call for a non-covered repair, You will be responsible for all osts associated with the repair. In the event You are unable to meet the servicer, You must call to cancel the appointment in advance of the agreed upon time of service. You may be responsible for paying the second trip charge for the subsequent rescheduled repair. If the product is found to be performing to the manufacturer?s specifications, it will be returned to You. This contract must be paid in full prior to services being rendered.
5.TIME FOR SERVICE. Service will be performed during the hours of 8:00 a.m. to 5:00 p.m. local time Monday through Friday, excluding holidays. Any additional costs above the service providers authorized hourly rate (premium or overtime charges) or after hours service will be at Your expense with exception of health related or severe weather related emergencies.
6.PLACE OF SERVICE. Service will be provided by a manufacturer authorized service center, or the Dealer named in this Contract. After We authorize Your claim, We will arrange for service and We will cover the reasonable parts and labor costs that We authorize. You may be asked to provide proof of purchase as a condition for receiving service under this Service Contract. Your original purchase receipt should be kept with this service Contract in a safe place. (a) On-site service will be provided for Major Appliances and televisions greater than 42 screen size. All televisions (LCD, Plasma, Projection) with a screen size between 19 and 42 may be serviced either on-site or by depot repair, at Our discretion. If depot service is required, the cost to transport and/or ship the Product for service will be paid by Us. On-site service, if applicable, will be provided when Your residence is located within fifty (50) miles of an authorized service provider. If You are entitled to on-site service but due to environmental and/or technical requirements, certain repairs can not be completed in Your residence, or if You are located more than fifty (50) miles from the nearest authorized provider, the cost to transport and/or ship the Product for service will be paid by Us. On-site service where applicable requires clear, complete and easy access to the product by the authorized service provider and does not include removal or re-installation of an installed product. It is possible that certain on-site repairs will not be completed on-site, but will require that the product or parts of the product, at the servicer's discretion be removed for shop diagnosis and/or repair and then returned. (b) All other Product categories are covered for carry-in or depot service.
7.PARTS AND SUBCONTRACTING. Parts used to repair equipment may either be new or refurbished at Our sole option. Service may be performed by subcontractors.
8.UNAVAILABILITY OF FUNCTIONAL PARTS OR TECHNICAL INFORMATION. If We determine that We are unable to repair Your Product due to the unavailability of functional parts, service or technical information, the total liability owed to You under this Contract will be the lesser of (I) the current market value of a Product with equivalent specifications or (II) the retail price paid for Your Product minus sales tax and claims paid, in lieu of service repairs or replacement of the Product with equivalent specifications. In all cases where parts or technical information are on extended backorder for a minimum of sixty (60) calendar days, We will determine if a replacement or reimbursement will be made. All contractual obligations are fulfilled, in lieu of repairs, upon Product replacement, reimbursement or Contract term expiration. Technological advances may result in a replacement Product with a lower selling price than the original Product. If We replace the Product or buyout the Contract, the covered Product becomes Our property and We may, at Our discretion, require the Product to be returned to Us (or Our designee) at Our expense.
9.RENEWABILITY. This Contract is renewable at Our sole discretion.
10.LIMITATIONS OF COVERAGE. This Contract Does Not Cover: A. Any equipment located outside the United States. B. Service required as a result of any alteration of the equipment, or repairs made by anyone other than a participating servicing dealer, an authorized service provider, its agents, distributors, contractors or licensees, or the use of supplies other than those recommended by the manufacturer. C. Damage or other equipment failure due to causes beyond our control including, but not limited to, repairs necessary due to operator negligence, the failure to maintain the equipment according to the owner?s manual instructions, abuse, vandalism, theft, fire, flood, wind, freezing, power failure, inadequate power supply, unusual atmospheric conditions, or acts of war or acts of God. D. Service necessary because of improper storage, improper ventilation, including failure to place the equipment in an area that complies with the manufacturer‘s published space or environmental requirements. Misuse, abuse and any utilization of equipment that is inconsistent with either the design of the equipment or the way the manufacturer intended the equipment to be used, including cases in which the manufacturer of the equipment would not honor any warranty. E. Any utilization of equipment that is inconsistent with either the design of the equipment or the way the manufacturer intended the equipment to be used. Any installation that prevents normal service. Any and all cases in which the manufacturer of the equipment would not honor any warranty regarding the equipment. F. Equipment used commercially or in a commercial setting. An industrial or commercial setting is defined as anything other than a single family dwelling. Single family dwellings include: Houses, Townhouses, Modular Housing, Condominiums, Duplexes, and Apartments. Equipment used in recreational vehicles is not covered. G. Cosmetic damage such as, but not limited to scratches, dents, rust, stains. Expendable or lost items, such as, but not limited to ear buds or head phones. H. Consumable items are defined as any part that is considered consumable by the manufacturer and/ or any item that is designed to be consumed (wear out) during the life of the Product, regardless if it is consumer replaceable or not. Consumable items include, but are not limited to For Consumer Electronics: light bulbs, lamps (unless purchased as additional coverage), and batteries. For Printers, Copiers, and Multifunctional Equipment: ink, fuser, roller kits, maintenance kits, paper trays, and any toner/cartridge. For all Products: Telephone or other lines connecting to the equipment. I. In-warranty parts not provided or shipped by the manufacturer. Operational or mechanical failure covered by manufacturer?s warranty, manufacturer?s recall, improper construction, or factory bulletins, (regardless of whether or not the manufacturer is doing business as an ongoing enterprise). Defects in the equipment due to the manufacturer?s error or improper construction of the equipment. J. Any software, including but not limited to, application programs, network programs, upgrades, formatting of any kind, databases, files, drivers, source code, object code or proprietary data, or any support, configuration, installation or reinstallation of any software or data. K. Normal, periodic or preventative maintenance, customer education and cleanings. L. Consequential damages as a result of malfunctioning of or damage to an operating part of the covered equipment or damages as a result of any repairs or replacements under this agreement. Damages caused by delays in rendering service or loss of use during the period that the product is at the authorized service center or otherwise awaiting parts are not covered. M. Loss or damage as a result of violation of existing federal, state and municipal codes including repairs to products not complying with said codes. N. Pre-existing conditions (incurred prior to the effective date of coverage), and known to You. O. Equipment where the serial plate attached to the equipment is removed, defaced or made illegible. P. Markings or retained images on the glass panel resulting from viewing fixed images (including, among other things, non-expanded standard 4:3 pictures on wide screen TVs, or onscreen data in a stationary and fixed location). Damaged or defective LCD screens when the failure is caused by abuse or is otherwise excluded herein. All display products that are used in an application that requires continuous and/or business operation. Q. Damage resulting from unauthorized repair; software virus; improper electrical wiring and connections; damage caused during delivery, improper installation, or setup, user facilitated minor adjustments and settings outlined in the product?s owners manual, external antenna or local reception problems, inaccessible products or parts, negligence, misuse or abuse whether willful or not. R. Payment for subsequent service calls which result in "no failure found" diagnosis. Non failure problems including but not limited to noises or squeaks. Subsequent trip charges may need to be paid by You if a second "no failure found" diagnosis is determined based on the same problem. S. Broadcast grade models are not covered by this program. Repair of resolution (pixels) failure must match the factory minimum standards before an authorized repair occurs. T. Equipment sold without a manufacturer?s warranty, sold "as is" or sold as refurbished Products or is located in a rental property. U. De-installation, removal, or reinstallation of any equipment. V. Any cost recoverable under any other warranty, guarantee, or under an insurance policy (in such case, this Contract will cover any applicable deductible). W.Transit or delivery damage, damage caused by packing, unpacking, assembly, installation, or removal. Short circuit, loss of use, parts or labor covered under the manufacturer?s warranty, lack of maintenance, bodily injury, pre-existing conditions, manufacturer?s recall, periodic checkups or maintenance. We will not pay for adjustments or repairs required because of conditions at your location. X. Electronics and PC equipment over 5 years of age.
11.NO LEMON GUARANTEE. During the term of this Contract, when three service repairs, with three separate claim numbers, have been completed on the same part, and that same part requires repair under a fourth claim number, as determined by Us, Your Product will be replaced with a Product of like grade and quality by Us, not to exceed the original retail purchase price. In the event a comparable replacement cannot be located, a buyout, not to exceed the original retail purchase price, will be provided. This does not include repairs necessary during the manufacturer?s warranty period, rework/ callback service required after initial service, during the warranty of work period provided by the Service Company, or previous service Contract terms. Once you have received Your Product replacement or buyout all contractual obligations under this Contract have been fulfilled.
12.CANCELLATION AND REFUND. You may cancel this contract at any time for any reason. If You cancel this Contract within sixty (60) days of the date purchased You will receive a refund of the full purchase price less any claims. If You cancel this Contract thereafter, You will be refunded the remaining days of coverage on a monthly prorated basis, less costs for service performed (if applicable). No refund will be issued if the prorated refund amount is less than or equal to $5.00. We, at Our sole option, may cancel this Service Contract due to non-payment. If We cancel this Service Contract due to non-payment, You will not receive a refund. Neither You nor the Dealer nor We are obligated to renew this Contract beyond the current term.
13.CLAIMS LIMITATION. The total claims limitation under this Contract is the retail price paid for Your Product minus sales tax, claims paid, delivery and installation. During the term of the Contract We may elect, at Our option, to buyout the Contract for the original purchase price of the covered Product less claims paid, less sales tax, delivery and installation, or replace the Product with a comparable Product. In the event We reimburse You or replace the Product We shall have satisfied all obligations owed under this Contract.
14.BUYOUT. We may elect, at Our option, to buyout the Contract during the coverage term for the lesser of (I) current market value of a Product with equivalent specifications or (II) retail price paid for Your Product minus sales tax and claims paid. When determining the current market value of a Product of equivalent specifications a fair analysis is completed using current manufacturers? and distributors? pricing on comparable products. All contractual obligations are considered fulfilled upon buyout of the Product. You have up to forty-five (45) days from the date of authorization to complete your product buyout transaction. Technological advances may result in a replacement product with a lower selling price than the original Product. If We buyout the contract, the covered product becomes property of Service Net and We may, at Our discretion, require the product to be returned to Us (or our designee) at Our expense.
15.STATE VARIATIONS. Certain states have specific conditions; conditions listed on the front of this form apply to You.
16.TRANSFERABILITY. You may transfer this Agreement to any person by sending written notice to: Service Net, P.O. Box 1411, Jeffersonville, IN 47131-1411.
17.NOVATION. If Service Net assigns another insurance carrier with an "AM Best" industry rating of A- or better under this Contract directly or indirectly, such new insurance carrier will carry the liability under this Contract.
18.RIGHT TO RECOVER FROM OTHERS. If we make any payment, we are entitled to recover what we paid from other parties. By accepting settlement of a claim, You transfer to us your right to recovery against any other party.
19.COVERAGE AND TERM. This is not an insurance policy. As the Administrator, We will assist You in understanding Your warranty and coverage benefits from the day You purchase Your Plan. If Your Product needs repair for operational or mechanical failure, You are required to call the toll free number listed on the front of this Contract or submit Your claim in writing to Service Net, 650 Missouri Ave., Jeffersonville, IN 47130. With any correspondence, please provide Your daytime phone number and claim number if applicable. If We fail to pay or provide service on a claim within 30 days after proof of loss has been filed, or in the event We are no longer a going concern, please enclose a copy of Your plan when sending correspondence to the Insurer. The expiration date and price of this Contract are listed on the face of this Contract. There are some limitations of coverage. You should review the limitations of coverage paragraph for details. This Plan is secured by a contractual liability or reimbursement insurance policy provided by either Illinois National Insurance Company or New Hampshire Insurance Company Inc., 175 Water Street, 20th Floor, New York, NY 10038. If, within sixty (60) days, we have not paid a covered claim, provided you with a refund or you are otherwise dissatisfied, you may make a claim directly to the insurance company.
20.ENTIRE CONTRACT. This is the entire Contract and no other oral modifications are valid.
21.LIMITATION OF LIABILITY. THE DEALER/RETAILER, SERVICE SAVER, INCORPORATED SERVICE NET, THEIR AGENTS, CONTRACTORS OR LICENSEES WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, LOST TIME, LOST DATA RESULTING FROM THE BREAKDOWN OR FAILURE OF ANY EQUIPMENT OR FROM DELAYS IN SERVICING OR THE INABILITY TO RENDER SERVICE ON ANY COVERED EQUIPMENT. EXCLUSION IS MADE OF ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES MADE HEREIN.
